      Clark Harmonson and the firm he previously worked for represented an Army sergeant when he was riding on a military bus to a field exercise. An 18 wheeler driver failed to yield to the right of way at a stop sign at a highway intersection and collided with the bus. When the bus driver was ejected, our client took the wheel of the bus and was able to safely stop the bus before it rolled over. Our client seriously injured his back and neck in the process. During the lawsuit, it was shown that the 18 wheeler driver negligently stopped at the marked stop sign. The case settled immediately prior to trial for a confidential sum.

      Harmonson Law Firm represented the son of a man who was killed in an 18-Wheeler accident outside of Austin, Texas. At the time of his death, the man was married and had five children and was living in the Austin area. The firm’s client, one of the sons, lives in El Paso with his mother. The father worked for a large trucking company that delivers refrigerated food. The man and a co-driver were travelling back to Austin from South Texas when the co-driver, for unknown reasons, exited the roadway and struck a concrete pillar. Our client’s father was ejected from the 18-wheeler cab and was killed instantly.

      Stephen Stewart, a personal injury lawyer and friend from Austin, Texas, represented the wife of the deceased and four children. I represented the minor son who lives in El Paso. We filed a wrongful death lawsuit against the man’s employer and the co-driver alleging that the co-driver negligently caused the accident. The key issue for my client’s claim was the psychological damage inflicted on my client as a result of the untimely death of his biological father. We sought the assistance of a well-qualified psychologist to assist our client and report on the emotional damage suffered by my client as a result of the death of his father.

      After a lengthy court battle, the case settled in mediation for a total sum of $2.95 Million. My client’s portion of the global settlement was $295,000 and the client received $183,672 after payment of attorney’s fees and case expenses. We were able to take that money and invest in a tax-free and guaranteed investment called a structured annuity which will provide for the client’s college or trade school and also make monthly payments to him for the rest of his life.

      A wealthy El Paso businessman was driving his son to school in his full-sized Suburban on a busy El Paso morning. He wasn’t paying attention to the road conditions and rammed his large SUV into the rear-end of a Chevy SUV occupied by two federal employees who were driving for work at the time. The wreck happened at the Sunland Park exit that, to anyone who lives on the Westside of El Paso knows, is often congested due to the road construction currently plaguing our city. Both the driver and the occupant hired Harmonson Law Firm to assist them in their claim against the wealthy businessman and his insurance company.

      Both clients received substantial injuries in the accident. The driver had to undergo several surgeries, including shoulder, neck and knee surgeries. The passenger had to undergo shoulder and neck surgeries. My co-counsel and I were able to assist the clients get the needed medical treatment they needed by working with a company that negotiates with surgeons and hospitals to fund surgeries in personal injury cases. Given the nature and extent of injuries, we needed to file a lawsuit to assist our clients when the businessman’s insurance company contested the nature and extent of our clients’ injuries. On the eve of trial, the case settled at a settlement conference for a total sum of $2.2 million dollars, each client receiving $1.1 million dollars. The driver client received $301,750 in his pocket after the payment of attorney’s fees, case expenses and medical bills. The passenger client received $335,011 in his pocket after the payment of attorney’s fees, case expenses and medical bills.

      Starting their young lives together, our clients, a young mother and her infant son, moved into an apartment complex with the boy’s father in the heat of a Las Cruces, New Mexico summer. From the day they moved into the apartment, things started to go south in the apartment for this young family. The air conditioner did not work. The window in the couple’s bedroom jammed and would not stay partially opened. Despite their own complaints and the same complaints made by a former tenant (as we were able to discover in the lawsuit that ensued), the windows and the air conditioner were not fixed by the apartment complex.

      On a hot evening, the mother opened the window of the bedroom apartment to get some relief from the oppressive New Mexico summer heat. While the mother was getting ready to go to a family dinner, her son, a precious two-year-old boy, wandered to the open window and fell out. The boy landed on his head and suffered a significant brain injury. The family hired us to take on the apartment complex. We enlisted the help of a safety engineer who opined that the apartment complex’s windows did not meet basic safety regulations which are designed to prevent the exact type of fall that our young client suffered. After a vicious court fight, the apartment complex and their insurance company agreed to compensate our clients $1.5 Million for the boy’s injuries.

      After payment of attorney’s fees and case expenses, the boy received $914,195 to help for his future needs. We were able to work with an investment company to purchase a tax-free and safe structured annuity which will make payments to the boy for the rest of his life. We also assisted the family set up a special needs trust which preserves the family’s Medicaid and still provide for the boy’s special needs.

      Our client, a medical assistant, was enjoying an early Sunday morning drive in downtown El Paso. Unbeknownst to her, a production crew of a famous national television show was in town filming and was driving in a recreational vehicle. The crew’s driver wasn’t paying attention to what he was doing and ran a red light in downtown and crashed into the vehicle driven by our client.

      The major concern of our client was her immediate medical needs because she did not have any health insurance. We were able to work with medical providers and get needed medical assistance for our client’s back injuries. The medical treatment included epidural injections for her spine and a micro-surgery when conservative treatment failed. After filing a lawsuit, we were able to settle with the TV production company for a total sum of $225,000. We negotiated with and repaid back all of our client’s medical providers and were able to put $100,000 tax-free cash into our client’s pocket after payment of the medical bills, attorney’s fees and case expenses.

      As a personal injury lawyer, I am often faced with helping negotiate high medical bills when the available insurance does not adequately compensate our client for his or her injuries. Such was the case when our client was thrown from his motorcycle and suffered significant injuries to his arm, hip and foot when a negligent motorist ran a stop light. Our client, a border patrol agent, was transported to UMC in El Paso and had to undergo surgery on his arm and foot.

      We were able to settle the claim against the at-fault driver for her insurance policy limits. We also made a claim for our client’s own underinsured motorist insurance policy limits and settled for those limits. The difficult part of this case involved dealing with UMC who filed a hospital lien and BCBS who made a claim for the majority of the settlement proceeds. UMC declared they were entitled to receive over $117,000 in their hospital lien. BCBS claimed a lien for over $25,000. Knowing the law and using it to my client’s advantage, I was able to drastically reduce the claims asserted by UMC and BCBS. After payment to UMC and BCBS and other medical providers and after payment of attorney fees and case expenses, my client was able to net $66,172 tax free dollars in his pocket.

      Clark Harmonson represented two people who received significant spinal and bodily injuries when an 18-Wheeler rear-ended the vehicle occupied by Mr. Harmonson’s clients on an Interstate. The lawsuit alleged that the truck driver violated the Federal Motor Carrier Safety Hours of Service Regulations, that the truck driver was placed out of service prior to the accident, and that the driver drove in unsafe weather conditions in violation of Federal Motor Carrier Safety Regulations. The lawsuit was filed in Texas and resulted in a confidential settlement for the victims of the collision.
